1. About these terms
These terms apply to your use of The Pigment Warehouse website and to any order you place with us. By using the site or placing an order, you agree to them. Please read them, and if there is something here you are not comfortable with, email us at hello@thepigmentwarehouse.com.au before you order.
We are The Pigment Warehouse, ABN 40 700 759 306, of Factory 11, 2135 Frankston Flinders Road, Hastings VIC 3915, Australia.
2. Who can order
You need to be at least 18 years old to place an order, or have a parent or guardian do it for you. By ordering you confirm that the details you give us are accurate and that you are authorised to use the payment method.
3. Our products
We sell high quality raw pigments: loose powders and flakes intended to be used as an ingredient by people making their own products. Where a pigment is cosmetic grade, its product listing says so. They are supplied as raw materials, not as finished cosmetics, and they are not medicines, therapeutic goods, food colouring or art supplies for children.
Product photographs and colour descriptions are provided as a guide. Screens vary, and how a pigment reads depends heavily on what you put it over and what light you look at it under. There is also natural variation between batches of these materials. See our Refund Policy for how we handle that.
Particle sizes, effects and other specifications are given in good faith based on the information available to us, and may be updated as we learn more.
4. Your responsibility when using our pigments
This is the important one, so please read it properly.
You are responsible for how you use what you buy from us. That includes:
- deciding whether a pigment is suitable and safe for what you are making
- checking which regulatory approvals apply where you are, including any restrictions on eye area, lip and mucous membrane use
- testing your own formulations, including patch testing
- following the safety information on the product page and on any Safety Data Sheet we supply
- labelling anything you make correctly if you sell it, and complying with the law that applies to you as its maker
We cannot advise on the safety or compliance of your finished product, because we have no visibility of your formulation, your process or your market. If you are selling what you make, get your own regulatory advice.
Keep pigments away from children and pets. Do not inhale the powders. Do not eat them. Use sensible handling, including a mask where appropriate, when working with fine powders.
Safety Data Sheets are available on request for the series we stock.
5. Prices and payment
Prices are shown in Australian dollars and include GST.
Your order confirmation doubles as a tax invoice. If you need one reissued, email us.
Prices can change without notice, but the price you see at checkout is the price you pay for that order. Shipping is calculated at checkout and shown to you before payment.
If a product is listed at an obviously incorrect price because of a typing or system error, we are not obliged to supply it at that price. If that happens we will contact you and either cancel and refund the order or confirm the correct price with you first.
6. Orders
Your order is an offer to buy. A confirmation email is an acknowledgement that we received it, not acceptance. The contract is formed when we dispatch your order.
We may cancel or decline an order, and refund you in full, if the item is out of stock, if we cannot verify your payment or address, or if we suspect fraud or resale in breach of these terms.
Stock levels are managed as carefully as we can, but if something sells out between your order and our packing bench we will contact you with the options.
7. Shipping and returns
Delivery is covered by our Shipping Policy and returns by our Refund Policy. Both form part of these terms.
8. Reviews and anything you post
If you leave a review or send us a photo, you keep ownership of it but you give us permission to display and share it, including on the website and on social media, with credit where we have it. Please only post things that are yours to post, and keep it civil. We can remove content that is abusive, misleading or infringes someone else's rights.
9. Our content
The text, photographs, colour descriptions and design on this website belong to us. Please do not copy our product photography or written descriptions for your own store. Sharing images of what you have made with our pigments is very much encouraged.
10. Reselling
You are welcome to use our pigments in products you make and sell. You may not resell our pigments in their raw form as though they were your own stock without talking to us first. If you want to stock us, email hello@thepigmentwarehouse.com.au, because we would rather have that conversation than a surprise.
11. Availability of the website
We do our best to keep the site running, but we do not promise it will be available without interruption or free of errors. We may change or withdraw products, prices and content at any time.
12. Liability
Nothing in these terms excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law, including the consumer guarantees.
Where the law allows us to limit our liability, our liability to you for any claim connected with a product is limited, at our option, to replacing the product or refunding what you paid for it.
To the extent permitted by law, we are not liable for loss or damage arising from how you use our pigments, including in any product you formulate, sell or give away.
13. Privacy
How we handle your personal information is set out in our Privacy Policy.
14. Changes to these terms
We may update these terms from time to time. The version on this page at the time you place your order is the one that applies to that order.
15. Governing law
These terms are governed by the laws of Victoria, Australia, and you and we submit to the courts of that state.
